Terms of Service

The short version

By creating an account or purchasing a service, you agree to these terms. You’re responsible for your account, the information you provide, and the choices you make while training. Cancellations require at least 24 hours’ notice. Session packages expire according to their stated terms. Train with Flex is a fitness service, not medical care — consult a physician before starting any new program.

1. Acceptance of these terms

These Terms of Service (“Terms”) are a binding agreement between you and Train with Flex (operated by Rafique D. “Flex” Cabral). By creating an account, purchasing a service, or using the website or mobile app, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.

2. Eligibility

You must be at least 18 years old to create an account on your own behalf. Users between 13 and 18 may use the service only with a parent or guardian’s consent and involvement. The service is not available to children under 13.

3. Your account

You are responsible for keeping your login credentials confidential and for everything that happens under your account. Please notify us promptly if you believe your account has been accessed without your permission. The information you give us at signup and during onboarding (including the PAR-Q+) must be accurate and complete; the training Flex designs for you depends on it.

4. What we offer

Train with Flex offers personal training, group training, digital coaching, lifestyle coaching, corporate wellness, and related services, together with a website and mobile app that support those services with program delivery, scheduling, logging, and notifications. Specific features, prices, and durations are described on the relevant product or service page and may change from time to time.

5. Purchases and payments

Payments for services and session packages are processed through Square. By making a purchase, you authorize the charge to your selected payment method and agree to the price and terms presented at checkout. Prices are listed in U.S. dollars and exclude any applicable taxes.

Subscriptions renew automatically at the interval shown at purchase until you cancel. You may cancel at any time, and cancellation takes effect at the end of your current billing period.

6. Session cancellation policy

We require at least 24 hours’ noticeto cancel or reschedule a session. Cancellations made with less than 24 hours’ notice, and no-shows, may be charged in full or deducted from your session package at our discretion.

7. Session package expiration

Session packages expire if not used within the following windows:

  • 4-pack — 8 weeks from purchase
  • 8-pack — 12 weeks from purchase
  • 12-pack — 16 weeks from purchase

Unused sessions after the expiration window are forfeited. Extensions may be granted at our discretion in cases of documented injury, illness, or other extenuating circumstances.

8. Refunds

Service and session-package purchases are generally non-refundable once the first session has been delivered. If you believe a charge was made in error, please contact us within 14 days and we will work in good faith to resolve it. Subscription fees already incurred are non-refundable; cancellation prevents future charges.

9. Health and fitness disclaimer

Train with Flex provides fitness and wellness coaching. We are not medical professionals, and nothing we provide is medical advice, diagnosis, or treatment. Physical exercise carries inherent risk of injury. Consult a qualified physician before starting any new exercise, nutrition, or supplementation program, especially if you have a pre-existing condition or have answered “yes” to any item on the PAR-Q+. You assume the risks of physical activity. By using the service, you represent that you are medically able to participate and that you will stop and seek medical attention if you experience pain, dizziness, shortness of breath, or other warning signs.

These terms are supplemented by the in-app Liability Waiver & Informed Consent, which you sign during onboarding before you receive any program. To the extent there is a conflict between this section and the waiver, the waiver controls.

10. Your content

The information you log inside the app — workouts, meals, habits, biometrics, photos — is yours. By submitting it, you grant us a limited license to host, display, and process it solely for the purpose of providing the service to you and the coaching team that works with you.

11. Our content

The website, the mobile app, the exercise library, training programs, written materials, branding, and other content we make available are owned by Train with Flex or its licensors and are protected by intellectual-property laws. We grant you a personal, limited, revocable, non-transferable license to use them for your own training. You may not copy, redistribute, resell, or use our content to develop a competing service.

12. Prohibited conduct

You agree not to:

  • Use the service for any unlawful purpose;
  • Share your account, resell access, or use another person’s account without permission;
  • Attempt to probe, scan, or test the vulnerability of the platform, or to defeat any security measure;
  • Interfere with other users, with Flex, or with the platform’s normal operation;
  • Upload content that is unlawful, abusive, or that infringes someone else’s rights.

13. Suspension and termination

We may suspend or terminate your account if you breach these Terms, if your conduct creates a risk to other users or to Flex, or if we are required to do so by law. You may close your account at any time by contacting us. Sections that by their nature should survive (payment obligations, intellectual property, disclaimers, limitations of liability, and dispute resolution) will survive termination.

14. Disclaimers

The service is provided “as is” and “as available.” We disclaim, to the maximum extent permitted by law, all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific training result.

15. Limitation of liability

To the maximum extent permitted by law, Train with Flex, its affiliates, and Flex personally will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability for any claim arising out of or relating to the service will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Train with Flex and Flex personally from any claim, demand, or loss arising out of your use of the service, your breach of these Terms, or your violation of any law or the rights of another person.

17. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be brought in the state or federal courts located in New York County, New York, and you and Train with Flex consent to the personal jurisdiction of those courts.

18. Changes to these terms

We may update these Terms from time to time. When we make a material change, we will update the “Effective” date at the top and, where appropriate, notify you in the app or by email. Your continued use of the service after the change becomes effective means you accept the updated Terms.
